The malicious intent is an interesting lynch pin to it, as well.

I once made a very graphic, very bad crank call in my younger years. The police got involved, and though what I said was dark and violent in nature, it was not said with malice (just a joke in really bad taste to a friend), I didn't get into any trouble besides having the police scare the warm yellow liquid out of me.

Then again, perhaps that falls into a different category (ie, my friend not pressing charges), so what do I know? Just never to do that again... =P
