Canada: "US no longer considered a 'Safe' country"

A valid question would be:

" What does this court ruling actually prove.... about the USA, about Canada, about illegal aliens?"


It's not about illegal aliens, it's about refugee claimants.

It's about the internationally recognized concept that someone can flee thir country, and as soon as they reach a safe country, they can apply for refugee status in a 3rd country. The safe country concept allows a refugee claimant to stay in the first safe country they reach. The US has said they would detain and possibly deport such claimants.
 
We will leave to another day the issues of whether so called refugee claimants may not in fact be obviously illegal aliens, and whether that is widely recognized.... or more notably, widely followed.

Right now, not being from Canada, I wonder if somebody more familiar can advise:

Was the USA a party to this action?

Was it represented therein?

Is the judge's decision open to appellate review?

Is the judge's decision in line with the official positions of the executive and the legislature of Canada?
 
I wonder, tho, how Canada would feel if thousands of Americans started flowing over their borders on a daily basis "Claiming" that they were all political refugees?

It's estimated by police and INS that almost 2000 aliens "immigrate" to the U.S. illegally on a daily basis... (according to CBS news, take that # for what you will) and if even a 1/3 of those guys "wised up" and used the loophole saying "We are Not Aliens, we are Refugees" and we were expected to simlply accept that...

Would Canada? Would any nation? Or is this just another example of trying to make the US out to be the "Big Evil?" I'm betting if that were the case ANY nation would stop it a LOT sooner than the US did.
 
Hey... frankly I'm glad that they consider America unsafe to live. This just means that if I ever needed too, I could claim refuge in Ontario and demand a job and healthcare if things ever got too bad here. Too bad I would have to disguise my dog and hide my weapons, but whatever. ;)

You know, they don't just take your word for it. You have to prove it. If you're just some guy from Detroit they won't let you claim refugee status.

Has nothing to do with it. When somebody hops the first flight out of a country where they are persucuted, and every country has a list of other countries that they will entertain refuge claims from, and lands in the US, and makes his way to the Canadian border, the safe 3rd country idea means that the US should accept that person ubtil the claim is reviewd by Canadians. Same thing the other way.

Put it another way, a gay Xtian female gets on the first flight out of Saudi because she fears for her life there. That flight land in London. She makes her way to the US embassy and claims refugee status. What should the US do? What should Britain do? Safe 3rd country means that she can stay in England until the US processes that claim. Simple.

Right but as CanuckMA pointed out in the post above, the idea is that they are supposed to be allowed to stay until its disproven by a 3rd country. So the theory is You or I could hop the border say "Im seeking asylum because I am a Gay Christian and I fear for my life" to say, a Greek embassy there, and be allowed to stay until Greece reviews your case... Now imagine there are 1000 of us a day doing it, how long before Greece gets to us, if ever, and meanwhile there we are, safe and sound living off the Canadian Teat. The idea has merit and value, but it seems to also have a huge loophole in the process.
